This Software Licensing Agreement ("Agreement") is a legal agreement between you and Nitramite (2557665-5). By installing and using any digital material provided by Nitramite, you agree to be bound by the terms of this Agreement. These are the only terms by which Nitramite permits copying or use.

NITRAMITE LICENSE AGREEMENT FOR ANY DIGITAL PRODUCT PRODUCED BY NITRAMITE

General terms:

1. THE SOFTWARE.

The Software licensed under this agreement is the computer, mobile, or any other program FROM NITRAMITE, which consists of executable files, data files, and documentation.

2. GRANT OF LICENSE.

NITRAMITE grants you the right to use the Software in accordance with the terms of this Agreement. You may load the software into RAM as well as install it on a hard disk or other storage device. You may not modify, translate, disassemble, reverse engineer, decompile, or create derivative works based upon the Software. You agree that the Software will not be shipped, transferred, or exported into any country in violation of the U.S. Export Administration Act and that you will not utilize the Software in violation of any applicable law. (this all applies with every device capable of running content from NITRAMITE)

2.1. FREE VERSION LICENSE.

You may distribute links to the free version (link for Google Play) of the Software freely to other users, provided that any copy must contain the original, unaltered files and proprietary notices. You have the ability to buy the ad-free version at any time by purchasing the ad-free version from the original source.

2.2. REGISTERED VERSION LICENSE.

When you purchase the ad-free Software, you will receive the full version, if such a version is available for that particular application. You agree not to distribute the full version to others and to use it only for your own personal use. You acknowledge that distribution of the registered version to others, whether intentional or unintentional, could damage NITRAMITE both financially and professionally. Any unauthorized distribution of your registered version will result in immediate and automatic termination of your license or right to use our content.

2.3. REGISTERED VERSION UPDATES.

NITRAMITE takes no responsibility for updates breaking the registered version meaning the application does not work anymore as intended. If your phone's operating system receives an update which results in the application stopping working, NITRAMITE won't provide immediate support to fix the possible problem. You don't have the legal right to receive money back in an operating system update situation because the operating system update installation is accepted by the user. Receiving money back is case-specific, if you have used the application or software for months which is identified by your order id, you have no right to get money back because you have received remarkable value based on the time you have owned the registered version of the application or software.

3. COPYRIGHT.

The Software is owned by NITRAMITE and is protected by international treaties. You must treat the Software like any other copyrighted material, except that you may give the download link of the free version of the Software to other persons under the terms of this Agreement. You may not distribute copies of the full ad-free version to others.

4. NO WARRANTY.

THE SOFTWARE IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. NITRAMITE WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE, OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES. NITRAMITE DOES NOT TAKE ANY RESPONSIBILITY FOR DAMAGE CAUSED BY THE CONTENT OF NITRAMITE. USE AT YOUR OWN RISK.

5. TERM.

The term of this license grant is perpetual. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. Your license to use the Software will automatically terminate if you breach the terms of this Agreement.

6. GENERAL PROVISIONS.

This Agreement is the sole and entire agreement relating to the use of Nitramite software and digital products and supersedes all prior understandings, agreements, and documentation relating to such use. If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will continue in full force without being impaired or invalidated in any way.

7. DISTRIBUTION.

NITRAMITE allows and encourages all websites to distribute the free version of this NITRAMITE Software. The software must be unmodified and in the original release state released by Nitramite.

8. GOOGLE ADMOB AND GOOGLE PLAY BILLING.

Our mobile applications use Google AdMob for advertisements and Google Play Billing for in-app purchases. For more information on how Google collects and uses data through AdMob, please refer to the Google Privacy Policy. For details on Google Play Billing, please refer to the Google Play Terms of Service.
